IMPORTANT! PLEASE READ CAREFULLY.
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND MMOBAY CO LTD.
1. You will not defraud another user or interfere with another user's trades.
2. You will not take any action to undermine the rating and feedback systems.
3. You agree to contact MMOBAY first if there is a problem with any transaction and to use the MMOBAY dispute resolution process to resolve the problem.
4. You affirm that you are an individual (e.g., not a corporation) and that you are at least eighteen (18) years of age.
5. You affirm that all the items you listed for sale was not obtained through illegal means.
6. You understand and agree that the game developer and publisher make no representation as to the value of the traded items and are not responsible for any loss of value that you may suffer as a result of purchasing or selling on MMOBAY.
7. You understand and agree that the game developer and publisher at all times retain full ownership of the game, its components and items contained therein, as well as their and the game's trademarks and copyrights. By trading on MMOBAY you certify that you are exchanging with the other party only the right of use to the item granted to you by the developer and/or publisher.
8. You certify that you are not using MMOBAY for any purpose other than completing trades and that you will not use information you obtain as a result of such trades to negatively impact other users in any way. By way of example this would include reporting or threatening to report a user's trading activities to any party other than MMOBAY. You also certify that any information on other users that you obtain through MMOBAY and its web sites will not be shared with anyone at any time or for any reason other than if subpoenaed by Court of Law, in which case you shall immediately notify MMOBAY of the subpoena and provide a copy within five (5) days of receiving such subpoena.
9. You agree not to hold MMOBAY liable for other users' actions, inactions, postings or communications.
10. You acknowledge that MMOBAY has no control over and therefore cannot guarantee the truth or accuracy of listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction.
11. You agree not to post information or material that is false, inaccurate, defamatory, libelous, unlawful, threatening, abusive, harassing, deceptive, fraudulent, invasive of another's privacy, tortuous, obscene, offensive, or profane.
12. Without limitation to our other remedies, MMOBAY may at any time and without notice limit, change, suspend or terminate our service, suspend or terminate any user accounts, prohibit access to our web site, remove hosted content, and take technical and/or legal steps to keep users off the site.
13. MMOBAY may change or modify this User Agreement at any time by posting new terms and conditions on this page. Your continued use of the MMOBAY web site following any changes or modifications to this User Agreement constitutes your acceptance of the changes or modifications.
14. You expressly acknowledge and agree that any material or content that you make available on the MMOBAY web site may be made freely available by MMOBAY through the MMOBAY web site, including without limitation for download by other users. You represent and warrant that you have all rights necessary to publish and distribute any material, content, or items made available by you through the MMOBAY web site and that such material conforms to the requirements and restrictions contained herein. You agree to indemnify and hold MMOBAY and its affiliates, officers and employees harmless from any claim or demand made by any third party due to or arising out of your access to or use of the MMOBAY web site, violation of this User Agreement, or the infringement or violation by you, or any third party using your account, of any intellectual property or other right of any person or entity. This agreement will be governed by the laws of the State of California in the United States of America.
15. This User Agreement is not assignable, transferable or sublicensable by you except with MMOBAY 's prior written consent. MMOBAY may transfer, assign or delegate this User Agreement and its rights and obligations without consent.
